Pop Site Terms and Conditions
Introduction
Welcome to Pop Site ("we," "us," "our"), a website builder owned and operated by Pop Website Technology Corp. Pop Site allows users to easily create and customize websites.
By accessing or using www.pop.site, you agree to these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Service.
Changes to These Terms
Pop Site may update these Terms as our platform evolves.
Where reasonably possible, material changes will be communicated through the platform or by email at least thirty (30) days before taking effect.
Your continued use of Pop Site after updated Terms become effective constitutes your acceptance of those changes. If you do not agree with the updated Terms, you must discontinue use of the Service and cancel your subscription.
Your Account
Sign in is available through Google, email and password, or other supported authentication providers. You are responsible for maintaining the confidentiality and security of your account. You are responsible for all activity occurring under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, or have verifiable permission from a parent or legal guardian, to use the Service. You may not share your login credentials with others.
Plans, Billing, Payment, and Cancellation
4.1 Free Plan
The Free Plan allows you to build and publish a website using a Pop Site subdomain (for example, yourname.pop.site) and access the features included in the free tier.
4.2 Paid Plans
Pop Site offers paid subscription plans, including but not limited to Pro, starting at $14.99 USD per month, or lower pricing where available based on your country or region, including promotional or regional pricing such as $4.99/month or $2.99/month. Additional paid plans and features may be introduced from time to time. Features and pricing may vary by plan and region.
4.3 Starting a Paid Subscription
A paid subscription begins only after you voluntarily enter a valid payment method and successfully complete your first payment. Pop Site cannot charge your payment method unless you have entered your payment information and authorized the initial transaction. By submitting your payment information and completing your purchase, you authorize Pop Website Technology Corp. and its payment processor to automatically charge your selected payment method for recurring subscription fees until your subscription is canceled.
4.4 Automatic Renewal
Your subscription begins on the date of your first successful payment. Unless canceled, your subscription automatically renews every month, and your payment method will be charged on the same calendar day of each subsequent month (or the closest applicable date when necessary). Where your plan has an initial term longer than one month (for example, an annual plan), and where required by applicable law, we will send you an advance renewal reminder before the renewal date. You authorize these recurring charges until your subscription has been properly canceled.
4.5 Cancellation
You can cancel your subscription at any time, immediately and without contacting support, by visiting Account Settings within your Pop Site account and completing the self-service cancellation flow. If you'd prefer, you may instead email hi@pop.site and we will provide instructions, including a link to the applicable cancellation process, but this is offered as a convenience, not a requirement; you are never required to contact us to cancel. Your subscription remains active until the cancellation process has been completed. Deleting your website, deleting content, removing your payment method, uninstalling integrations, closing your account, or simply stopping use of Pop Site does not cancel your subscription. You are responsible for canceling your subscription before your next renewal date if you do not wish to be charged for the following billing period.
4.6 Billing
Subscription fees are billed in advance for each billing period. If payment cannot be processed, Pop Site may retry the payment, suspend paid features, or terminate your subscription. You are responsible for maintaining accurate and current payment information.
4.7 Pricing Changes
Pop Site may change subscription pricing, introduce new plans, discontinue plans, or modify plan features at any time. The price displayed at checkout is the price applicable to your initial billing period. Future renewals will occur at the then-current subscription price unless prohibited by applicable law. Where required by applicable law, we will provide advance notice of a price increase before it takes effect on your account.
4.8 Refunds
Except as described below, all subscription payments are final. Except where required by applicable law, Pop Site does not provide refunds, credits, or partial refunds for subscription fees, partial billing periods, failure to cancel before renewal, lack of use of the Service, or suspension or termination resulting from violations of these Terms.
If you are located in the European Union, United Kingdom, or another jurisdiction that grants a statutory withdrawal or cooling-off right for digital services, you may have a right to withdraw within 14 days of subscribing. By choosing to access paid features immediately upon payment, you expressly request immediate performance and acknowledge that this right of withdrawal may be lost once the service has been fully performed, to the extent permitted by applicable law.
User Conduct and Restrictions
You agree not to use Pop Site to break any laws; mislead, defraud, harass, or exploit others; host hateful, violent, explicit, or illegal content; upload malware or malicious code; or engage in scraping, phishing, spamming, or unauthorized automation.
5.1 Username Policy
Usernames may not infringe trademarks, copyrights, or other intellectual property rights. Offensive, misleading, or inappropriate usernames are prohibited. Pop Site may reclaim, modify, or remove usernames that violate this policy.
Termination and Enforcement
Pop Site may suspend, restrict, disable, or permanently terminate any account or website at any time if we reasonably believe these Terms have been violated. Where practical and where the violation does not involve legal risk, safety, security, or abuse concerns, we will make reasonable efforts to notify you before termination. Termination for a violation of these Terms does not entitle you to a refund of prior payments, except where required by applicable law.
Domain Management
Free users receive a Pop Site subdomain. Paid users may connect custom domains. Domain registrations and renewals are handled by third parties. Pop Site is not responsible for third-party registrar outages, transfers, expirations, or domain disputes.
Intellectual Property
You retain ownership of content you upload. You grant Pop Site a worldwide, non-exclusive, royalty-free license to host, reproduce, display, distribute, and process your content solely for operating, improving, and providing the Service. You represent that you own or have all necessary rights to any content you upload.
Liability and Indemnification
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. To the fullest extent permitted by law, Pop Website Technology Corp., its officers, employees, contractors, affiliates, licensors, and partners shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, business interruption, loss of goodwill, or loss of data.
To the fullest extent permitted by law, and except for (a) your indemnification obligations below, (b) your payment obligations, or (c) claims arising from your breach of the Intellectual Property or User Conduct sections, Pop Website Technology Corp.'s total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (i) the amount you paid to Pop Site in the twelve (12) months preceding the event giving rise to the claim, or (ii) $100 USD.
You agree to defend, indemnify, and hold harmless Pop Website Technology Corp. from any claims, damages, liabilities, costs, or expenses arising from your use of the Service, your content, your websites, or your violation of these Terms.
Privacy and Data Handling
Your information is processed according to our Privacy Policy. Pop Site does not sell your personal information for advertising purposes. We may share data with trusted service providers that help operate the platform, including payment processors, hosting providers, analytics providers, cloud infrastructure providers, and customer support providers. In connection with an acquisition, merger, financing, investment, restructuring, or sale of assets, your information may be transferred as part of the business.
Third-Party Integrations
Pop Site may integrate with third-party services, including MemberSpace. If you enable an integration, you authorize the transfer of necessary information between the services. Third-party services remain independent from Pop Site and are governed by their own terms and privacy policies.
Privacy Rights (GDPR and CPRA)
Users located in the European Union, United Kingdom, California, and other applicable jurisdictions may have legal rights regarding their personal information, including rights to access, correct, delete, or port their data, and to object to or restrict certain processing.
We process your personal information on the legal bases described in our Privacy Policy (including performance of a contract, legitimate interests, consent, and legal obligation, as applicable), and we retain personal information only for as long as reasonably necessary for the purposes described there or as required by law.
For users in the European Economic Area or United Kingdom, you also have the right to lodge a complaint with your local data protection supervisory authority.

International Data Transfers
If you access Pop Site from outside the United States, you consent to the transfer, storage, and processing of your information within the United States and other jurisdictions where our providers operate, using appropriate safeguards as described in our Privacy Policy.
Your Website's Data Collection
By publishing a website through Pop Site, you are solely responsible for complying with all laws applicable to your visitors. Analytics and visitor tracking may require notices or consent depending on applicable law. Pop Site does not provide native cookie consent management. If required, you are responsible for adding consent banners or disclosures using Pop Site sections or custom code.
For visitor data collected on your website: you act as the Data Controller; Pop Site generally acts as a Data Processor for hosting your site and providing platform functionality, and will enter into a data processing agreement with business customers upon reasonable request where required by applicable law; and Pop Site acts as a Data Controller regarding your own account and platform usage information. Compliance remains solely your responsibility.
Third-Party Sound Effects
Certain user interface sound effects incorporated into the Service originate from the SP-01 UI Sound Effects Library by SuprLunr and are licensed under the Creative Commons Attribution 4.0 International License (CC BY 4.0).
Changes to Privacy Practices
We may update our Privacy Policy from time to time. Continued use of the Service after changes become effective constitutes acceptance of those changes.
Prohibited Websites
You may not use Pop Site to create, host, publish, or operate websites, landing pages, forms, funnels, or other content that: (a) primarily collect personal information without a legitimate purpose; (b) impersonate or falsely suggest affiliation with another person, company, or government entity; (c) deceive, manipulate, defraud, or mislead visitors; (d) facilitate phishing, scraping, spam, fake engagement, bots, or automated abuse; (e) generate fake inquiries, fake signups, fake reviews, or fraudulent activity; or (f) violate any applicable law or the rights of any third party. Pop Site reserves the right to suspend or permanently terminate any account that violates this section.
Governing Law
These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be brought exclusively in the state or federal courts located in Delaware. Nothing in this section limits any non-waivable consumer protection rights you may have under the mandatory laws of your country or state of residence.
